Many of us have attended mass events such as concerts, matches or festivals where photos or recordings were taken. The question often arises whether the person capturing our image had the right to do so and whether they can freely distribute it.
Prof. Marlena Sakowska-Baryła invited attorney Henryk Hoser to discuss the legal aspects of disseminating images of people attending mass events. The starting point for the discussion was a recent high-profile case – an unfortunate moment captured by the so-called "kiss cam" during a Coldplay concert, which sparked a broad debate about the limits of privacy in public spaces.
This event is a prime example of how complex the issue of image protection in public spaces is today. Recording and disseminating images acquired at mass events raises numerous legal issues and liability for their publication can be assessed differently, depending on the context, intentions and consequences of such action.
